Letting people use your personal pool when you are not home?

Hi there!

I am new to this site and wasn't sure if this is the correct place to post. I am just looking for advice/opinions. We recently bought a home with a 14,000 gallon above ground pool. It hadn't been open in two years so it took some time but we've finally gotten all the parameters where they should be but now we are having other issues.. with visitors. Particularly my fiances family, I don't feel comfortable having people at my home utilizing my pool when I am not there, I feel like there is more risk than reward involved in that situation and I'd rather not be liable even if it is family.

My fiance does not agree nor understand this. Here is an example: His mom texted him this morning (different from last week when she just showed up, at least) asking if her and her friend can come swim today while him and I are working. He asked me and I again expressed I do not feel comfortable with this for various reasons. I contacted her letting her know I'd be off around 5 if they'd like to come then she proceeded to let me know they have plans and she was planning to come at 11am today and leave before we'd be home.

My fiance does not understand 'what the big deal is' and refuses to back me up regarding the personal boundaries of our home. His sisters also feel as though they can just come swim and bring their friends as they please. We haven't been able to have any weekends or time to ourselves as we both work 40+ hour work weeks.

Please Help.. Any suggestions on how to deal with these situations in a more productive manor?

Mother, I would agree with you fiancee. Mother and friend, I agree with you.

In situations like this, when friends or family repeatedly ask to use your pool, just hand them your pool builder's business card.

The problem is if little Johnny slips and breaks his head open too many people want to blame and sue. People Have forgot an accident is an accident!
My dad told me to get an umbrella policy to help protect you. If you have a pool look into it. Can get a million dollar policy for not a lot of money.
Heck people can climb your fence and get hurt and sue you.

Has anyone had visitors to your pool sign a waiver before they enter? Would this be legal and help protect a pool owner?

It will be up to a Judge someday if you find yourself in court waving a piece of paper around.

In the process of building a pool in a new construction neighborhood with LOTS of little kids. My thought is having a waiver signed may not really mean anything legally, but would make anyone invited over to the pool know that my wife and I are seriously concerned about liability of owing a pool. Does that make sense? Or is it just a goofy idea?

We had a neighbors college age Daughter house sit and watch our dog once for a weekend..I told them NO visitors..When I got home and looked at my outside camera is was 2 girls and 2 guys outside swimming and Going in and out of the house. We have been friends with that family for years and their parents weren't happy either. I let it go since everything worked out but Kids just don't understand if something happens I am on the hook.
We have since found a girl we can trust and I tell her she can sunbath all day but I strong prefer they don't swim and she hasn't

not for the pool, but I am on the family ranch and the property contains some scenic rocks that people love to visit, so we do have a liability waiver we have people sign. however, we all know it will actually be the party that hires the best lawyer who will win if it comes to going to court. and children getting hurt are ALWAYS an exception, you aren't going to win that.
