spa heat maxes out at pool setting or (95).

If I understand correctly they want the pool turned to off but when that is done theheat never turns on.
 
When setting the H P for remote operation the last step says to press either up or down button till "E" appears. This will not work when pool is set to off.works if a temperature is set but spa will not go above set temp.

Did you check the calibration of the thermocouple? I had a similar-sounding problem a while back. Spa would not heat up above 95 or so, but the water temperature was reading 104 on my controller. Basically, this water temp sensor was reading higher than the actual water temp and preventing the heater from fully heating the water. It was a simple task to recalibrate it. Now it reads too low at lower water temps, but that’s not an issue for me.
 
Water temp reads 80. spa will go right to 95 if pool temp is set to 95 on the H P but if I set it to off per instructions theheat never turns on.

I think you are confused about how your HP operates but I cannot help you without seeing what caused your confusion.
