Shallow End too Deep (UPDATES)

Good points about adults being in the pool with the kids, and that is one reason I want it fixed. The incorrect 3.5 to 5' area is over 15ft in length and that is fairly steep if you are just hanging out as adults. The little ones will be all in that area as well. They will be there or jumping in the deep. Well the incorrect 5' area should be 4', in the middle of the pool. So you can get some distance from the littles in the shallow or the deep. Now the littles and adults will be crammed back at the shallow wall.
Poolgate, the number I've heard is 1:3. I'm not positive though. This would be no problem for mine if they raised the shallow back to 4' where it should be in the diagram. They would have plenty of lateral length to drop from 4' to 7'
So I'm meeting with the pool builder owner, project manager this week. Project manager is telling me they did nothing wrong, per contract and change order the pool is 3.5 to 7 ft, and that any change to the floor contour will be at my expense.
Technically he is correct. The contract specifies a 3.5 to 6ft and the change order is 3.5 to 7ft because they over dug. But the construction plans show what the contour should be in the shallow end. I confirmed a couple times that the 7ft deep end change will not affect the shallow end. Unfortunately that is not in writing. Am I stuck?
Up until this point, the process and work has been great...no complaints at all. Plus they have been much quicker than other PB's in the area.

I think you are over-thinking how much the slope will effect people standing in the pool. Once in the water, the slope is much less noticeable. If I go to my pool where it switches from a gradual to a steeper slope towards the 9 foot deep end, it doesn't bother me at all and really I don't notice it much. Not sure what you can do at the moment I guess just wait and see what the owner says.
who requested the change order? Did they overdid then ask you to accept that work, and being a reasonable person you said, "okay?" If so these are the points you need to make:

The original contract describes the functional contour and size of the shallow end - nothing in the change order supersedes the size and dimensions of the shallow end.
3) You confirmed verbally with them that the shallow end would be not be affected.
4) To stress again - their mistake lead to this. Their second mistake in not creating a more specific change request lead to this misalignment of expectations. And their 3rd mistake in not sticking to what was verbally confirmed about your understanding of the change request.

Hi Poolgate....I think the slope will be tolerable for adults standing in the current 3.5 to 5ft shallow. The problem is that adults usually don't stand in 5' deep water since it will be at my chin and my wife's nose.
The problem is that you will be confined to a very small portion of the pool for the adults to hang out. That same small spot will also be where the kids will be splashing and playing. So the big issue is very little space for adults to stand in and virtually no space for kids that 48" tall to touch.

Yes the change order for the 7ft deep end was due to their error. It was originally to be 6'.
You are correct this is where things went south. The project manager didn't specify to the gunite team onsite that the shallow needs to remain unchanged.
