The spas in your pics are not really below the pool water level.. They just took the pics when the spa was in the "spillover" mode. So they are putting more water into the spa than it can handle, and it spills over into the pool.
Think about it for a minute.. If the spa was below the level of the pool water, how would you ever be able to heat it without heating the pool..
I am not saying it can't be close to the level of the pool, I just can't see it being below the level of the pool water..
But then again, I've been wrong 100 times today alone, so I don't mind 101, but you've got to prove it first..
