Closing company responsible for frozen pipe?

its 3" pipe for sure. They look to be 2x 22.5 degree elbows as the pipe needs to head up hill at that point. The pipe is much less aligned now than it was when it was first opened up. Just got moved around while digging to get under it.

If the damage is potentially from stress is there any case to be made to replace the one that is not broken to hopefully keep this from happening to that one? Or is there more risk than benefit of messing with it?

You can't really tell just from looking at it.

To me, it looks off, but that is hard to tell for sure.

It might be fine and it might be overstressed.
 
sigh.....

So they came out today to fix it which they did. They replaced the 2x 22.5 degree elbows with 4x 90 degree elbows (4 lefts to go straight....) so we'll get a bit less water down the slide due to increased head pressure.... No bill yet so not sure what will happen on that front but at least its fixed.
 
Just to close this out. They did come out and fix it, in a very odd way and it does not appear they plan to bill me for the plumbing work. I did hire and pay the guy that does our pavers to lift the pavers and he also dug the hole and found the broken pipe and I also paid him to fill the hole in and replace the pavers. I'd have had to do the later no matter what. All in all I am pretty happy with the outcome even if it was an inconvenience that I wish I wouldn't have had to deal with at all.
