I think gwegan is suggesting ripping a 2x4 at a 45 degree angle and mounting so that it can't be climbed:

How long is the fence? How high? How far between the hortizontals?
If you block access to the hortizontals with some wire mesh, it will meet code. Basically, if a kid can't get a toe hold, it meets code if high enough.
