That is correct! CircuPool severed the relationship with CompuPool in the fall of 2012, four years ago! Please do not confuse the two companies.

We are always glad to have an opportunity (again) to point out that CircuPool is not Compupool. Although the marketplace confusion is common, CircuPool is not affiliated in any way with the Australian company and never has been.
Seems like conflicting information?

In this post, they say that they have never been affiliated with Compupool.
 
In any case, it seems like they go through a lot of trouble to try to obscure the actual company that is the manufacturer of record for the products.

In other words, if someone wanted to sue the manufacturer for whatever reason, who would they actually sue?

Is there a company registered somewhere called Circupool Products as it says in the warranty statement?

If not, who is the responsible legal entity?

For any legal paperwork like a contract or a warranty statement, the correct way to refer to the company would be "Pace Car Corp DBA CircuPool Products".

Using only the assumed, fictitious or DBA name is inappropriate for legal documents.

On January 5 2009, Donald registers the Assumed name CIRCUPOOL SYSTEMS.

On May 8, 2009 Pace Research Ltd. applied for a trademark on the term Circupool.

On April 4 2012. Donald says: “Our company, Discount Salt Pool, is the exclusive distributor for CircuPool in the USA. The units are made by Compu Pool in Australia, in business since 1979”.

From Nov 7 2012. “Our legal DBA’s have been PoolBids.com and Discount Salt Pool”.

So, even though they have registered an assumed name and a trademark, they do not claim ownership of the Circupool name, which seems odd.

Why not just claim ownership of the Circupool brand?

In any case, it seems like there is no legal entity called Circupool Products.

So....Dilemma time....

I called DSP this morning, got quickly transferred to the senior tech guy, who quickly transferred me to a manager.

They are clearly not used to customers armed with a wealth of pool chemistry and diagnostic information (probably because most don't have a clue about their pool chemistry :smile:). They definitely would not be testing for 'Quantity of FC Produced'.

I think he understood what I was generally unhappy about, though didn't entirely buy my argument because in his mind there are "just too many variables to measure"

Somewhat to his and the company's credit, he saw he had a bad situation on his hand with an unhappy customer and did offer a full refund upon return.
So....do I return it?

The U-55 if it got anywhere close to 2.9 Lb/Day was an incredible deal. If it's getting 40%-50% of that (which it probably is), it might be getting a bit less production than the top capacity Hayward or Pentair SWG's, at maybe $500 less. Whether it lasts the same lifetime...who knows at this point?
So if I am not going to go back to lugging jugs, it might be best to swallow my pride and keep it and start shopping for a Variable speed pump, which will definitely be needed.

I did propose to him a refund of 50% of the purchase price because it's getting 50% production and I keep the unit. He thought that was just too goofy!

I'm taking a vote! Who says I return it and who says I should keep it!!

Oh...and I also told him he really should check out TFP and how many posts there are from people questioning the inflated production specs!!!
I would not be surprised if they have been monitoring these discussions. The forums are open to all visitors without logging in.

I would assume they already know what is incoming.

I think he genuinely was unaware, though he definitely knows of TFP. That doesn’t mean nobody at the company has been monitoring.

I know that feeling. :brickwall: Before July 4th I was all ready to return with an RMA assigned. But I decided to wait. I may not be generating what is projected and calculated by the Poolmath APP based on Circupool's advertised specs, but I am generating chlorine, so ......................................

They are not "Just a distributor".

Technically, maybe, because Pace Car Corp is the legal entity doing business as CircuPool Products, but they are all owned and controlled by the same people.

In any case, if they were given production figures, then they can tell you who specifically gave them the figures and you can request the production figures report that they claim they were given.

Maybe they have the report in their right hand and hand it to their left hand.

It's the same exact people that own, operate and control the companies.

I would want an exchange for the same unit. That would solve some of the mystery. If it yields u the same production- u have your answer. If that’s the case, As u stated, it’s still a robust unit for the $$. Hopefully the unit u have has an issue & the new one would yield more fc!
