Gunite done/spa crooked...need advice

Gunite in pool and spa is complete and the spa which is the centered, visual component of the pool is not parallel with the house per the specs. I measured the spa from the house and one side of the spa is 4 inches closer to the house than the other side. The spillway is also crooked by a similar amount. I paid extra to have the spa be more of a focal point (raised up 12 inches and moved to center of the pool) and now those will actually bring out the flaw more. Can this be fixed? Contractor coming out tomorrow to discuss solutions. I read in the pool contract and it states "all pool and or spa dimensions are approximate with an acceptable deviation of up to 6 inches. Are my negotiations limited because of this language or do I have a way to recoup some cost due to contractors mistake? Thanks in advance.

There is really no advice we can offer. This really comes down to what you and your builder can live with and agree on.

TFP is mainly focused on pool owners helping other pool owners maintain theirs pools. So, we can not really offer any legal advice that would have any weight.

Seems in these cases, good communication between you and your builder is what is required.

Maybe my main question got buried in the text but I am really wanting to know if anyone has ideas to fix the issue.
Imguess I'm missing something, but what "solution" might you be looking for? It's not like it can be moved,

Once the pool,is,filled with water, you add a few potted,plants and a lounge chair or two a 4" difference is going to disappear.
 
Sure it can be fixed. tearing it down and starting over is one option. You have not given us a good picture as to what the problem is for us to even consider what a possible solution would be
 
Pictures of the situation might help.

Having had a build that was severely problematic, I greatly sympathized with you. If the "extra " you paid to highlight the spa has been negated, maybe you can get that extra money back. If there is nothing structural that is defective, it is most likely something that you will solely notice, and not be a glaring eyesore.
You'll be amazed how the entire yard is transformed once the build is finished, and your landscape, furniture, and decorations are in place. I'm speaking from personal experience.
