Must owners of private pools have a working pool light if swimming at night? Is that a Florida law? Must all in ground pools have a pool light?
 
64E-9.008 Supervision and Safety.
(1) All owners, managers, lifeguards or swimming instructors in charge of, or working at, public swimming pools shall be responsible for the supervision and safety of the pool.

(8) Night swimming – Pools shall not be open for swimming at night unless the requirements for lighting as specified in paragraph 64E-9.006(2)(c), F.A.C., are met. Night swimming shall be considered one half hour before sunset to one half hour after sunrise.

Section 454.1. 4.2 of the Florida Building Code (FBC) Lighting Requirements: Artificial lighting shall be provided at all swimming pools which are to be used at night or which do not have adequate natural lighting so that all portions of the pool, including the bottom, may be readily seen without glare.

 
"Under state codes, regulated pools cannot be open at night (defined as 30 minutes before sunset to 30 minutes after sunrise), or when adequate natural lighting is not available, unless the pool and pool deck have proper lighting for the safety of patrons. These standards are found in Chapter 64E-9.006(2)(c) of the Florida Administrative Code. The lighting plan has to be certified as compliant by an engineer licensed in Florida and must be approved by the local building department after a professional conducts a field inspection. Following approval, the phrase “night swimming approved” will be noted on the Florida Department of Health’s pool permit."


Looks like it is only required for Public Pools.

Were you told that a private pool must have a light?
 
I thought I read somewhere that private-owned pools must have a working pool light if swimming at night Maybe it was insurance companies who require it.

Why are you asking?

It is important for safety to have a light in or above your pool so that you can see the bottom of the pool at night.

How else might you see if a person or creature may be drowning in your pool?

A pool is an "attractive nuisance." Having a pool comes with safety responsibilities.

I am asking to see if a private pool owner must have a working pool light. Or, if broken, can he leave the light broken forever and never replace it? And can you swim at night without one? Maybe not safe, but does Florida law require the home owner to have an operating pool light when swimming at night. Just a question.

We do not give legal advice here but I have not heard of such a law for private pools.
 
Would be hard to impossible to enforce a law like that.

We require certificate of compliance for pool fencing when selling a property or a current certificate for rental properties but lighting is not included and lighting is not included for building compliance. If lighting was required a certifier would have to visit properties at night which wouldn’t happen.
