Dry Well Concerns

We recently had a cement/vinyl lined in-ground pool installed here in Long Island, NY.
We were ready to plan our design for the coping, patio, retaining walls & steps to the pool as the company said it was essential to install the pool at the highest point of the yard causing it to look absurd.
After finally accepting that matter, our mason guy discovers the dry well is only 37 inches from the pool. The minimum distance allowance is ten feet.
The mason guy told us, not only is it impossible for him to put a patio over it and not only will I not get a CO, he states in 1-2 years the pool walls will crack, stating it is now on tampered soil since the dry well is way too close.
what is your opinion, he states pool MUST come out.

I find it very unlikely that they could have dug the pool that close to a leaching structure without exposing the structure and having issues with whatever type of liquid that is going into the structure.
What do you think is going into this dry well? Is it septic or roof water or something else?
Do you have any pics you can post?
Do you have any pics of the original dig in that area?

This is a dry well Installed specifically for the in-ground pool.
The pool is a concrete, vinyl lined pool. It is 15’x30’. They installed the dry well 37 inches from the entrance to the shallow end.

Not comfortable posting pics yet as I am in some dilemma & am trying to plan a course of action.
There are 3 issues, main one, I’m told no matter what the pool needs to be removed as it’s on disturbed soil. Town already told me I cannot get a CO. Lastly, no patio can be installed there & it’s the entrance to my shallow end.

Can not really give much advice without the pics.

I can say that it is common and recommended practice to install a sump for any liner pool. It is usually placed more at the deep end but I see no reason for not getting a CO or no reason you can not install a patio on top.

Can you give any more details on why they think this will affect the pool? Sounds like it was placed in the over dig which was disturbed for pool installation anyway.

Something is not adding up here with what you are describing..
