Tempered glass on windows facing pool?

We're getting some replacement windows, and one of the salesmen (not all(?)) said that the window (not sliding door) has to be tempered glass per code requirements. We live in Pinellas County, FL. Can anyone point me to any information about this? We have a pool fence that is up all the time, and the window is at least 12 feet from the pool. We're already getting hurricane windows, so... ??? Is this really a requirement or an upsell?

Here’s the IRC code regarding safety glass for windows:
“Fixed or operable windows must include safety glass if they measure larger than 9 feet square, the bottom edge is less than 18 inches above the floor, the top edge is more than 36 inches above the floor, and there is a walking surface within 36 inches of the glass. Tempered glass is not required unless all four of these conditions are met.”

But if you are getting hurricane-rated windows, I would think that would suffice?

To be sure, you would need to check the code for your jurisdiction.

Best to check with local planning/building dept. As even the IRC can be overridden by local code. Of course, involving them could engage the permit process, so be clear on that before you call.
