Do you have a copy of the drawings?

Did the pool builder have oversight responsibility for the concrete contractor?

It seems to me that the pool builder would have been responsible for making sure that the deck was built correctly.

Ask the city inspector who is responsible for the problem.
Unfortunately my PB just built the pool and I hired all the subs, kinda smart on his part to operate this way.takes the liability off if him. I found the drawing attached the steps.

Contact the pool kit manufacturer and the autocover manufacturer to see what they say about the problem.

What does the concrete contractor say?

Did you hire the concrete contractor or did the pool builder hire them?

Was the deck included in the plans submitted for the permit?

Who created the design plans for the deck?
 
Were you acting as the general contractor?

What does the contract with the builder specify about who is responsible for the overall job?

Did the builder discuss the deck plans with the deck contractor?

My plan is to contact the concrete contractor next. The pb and concrete contractor are separate. The pb just does the pools and left all other subs foe me to hire. I do have the drawing that was submitted for the permit.

Do the drawings show the height of the step to the concrete?
No only the drawing I showed you which shows 8' 1/8" to top of pool wall.it does show I diagram of the pool adding 4" of concrete to the top though.

Ask the builder exactly how the deck should have been done to meet code and what should be done to fix the problem.

Ask the pool kit manufacturer how it should have been done.

Ask the pool autocover manufacturer how it should have been done.

See what the deck contractor has to say about how it can be fixed.

There has to be a way to do everything so that the pool meets code.
 
I talked with the concrete contractor he said he would never recommend only 2" of concrete around the pool, it would crack for sure...he also said pools with auto covers have a higher top step and there's no way around it.

I stated the code of 12" and he didn't have an answer.

The PB said the stairs come from the manufacturer set to certain heights so I'm not sure how this would be adjusted, as rhe liner is ordered according to the manufacturer specs...maybe if I used steps that the liner didn't go over they could have been adjusted...

If 14" is too high, would 12" work or do you want it less than 12"?

What is the maximum that you can live with and what would be ideal?

You probably could have done a 2" Coping stone and then a regular concrete deck and not a cantilever deck.
 
It's 8 1/8 to the top of the wall the auto cover track sits on top of the wall adding the 2". The PB said they have forms that can be adjusted for depth to accommodate the code. Only thing is that would leave the concrete at 2". This is too thin and would for surely crack.

You don't need track at the front.

You only need track at the sides.

You could have done 4.5" concrete behind the wall panels and then 2.5" to 3.5" thick going over the top of the panel.

That would give you an 11" to 12" step up.

The part that would be 2.5" to 3.5" would only be about 4" wide, which should be fine.

Remove the section of concrete at the front and remove the track on the front and repour everything lower.

The sides will need to transition to the height of the other concrete.

top is a little over 14"
8.5" + 2" + 4" = 14.5"

Remove the track and lower the concrete by 1.5" and that will give you 11" for a step.

The front concrete will be 3.5" lower than the sides, which you can transition to the side concrete over the distance.

Thanks for all the ideas, I think while more expensive fix im going to pull the liner and reform the steps. I'm also going to redo the bottom as I hate how shallow the shallow end is...I actually don't really want a deep and shallow, I'd rather have all 1 level like 4.5'. I have talked with a few pool contractors and have them drawing up some plans to do this next spring.
