Rebound after pool remodel

I had my pool remodeled in April 2016. Since the water filled there has been a leak in the spa. I complained that when I came out in the morning the spa water level was below the tile line. The longer it sat the more it went down. Originally the water was transferring somehow between the spa and the pool. After months of part time investigation, which included the contractor and a leak specialist (who said there there was no leak) they have concluded it is leaking due to Rebound.

During the course of the remodel, I was presented with drawings and invoices to approve for skimmer, silicone caulking and a crack repair in the deck. All documented, approved and noted. I then received a phone call when the spa was taken down that there was a small leak, but there were getting 10 psi and that it would pass inspection. The company was also adding a step in the spa and putting tiles on the step and bench. The bottom of the spa was dirt! They have traced the leaking to the tile area on the bench.

Now I'm told the spa needs to be redone and they don't know if it is minor or major work (ie $$$$). I am very hesitant to let this go forward with the same contractor. I do not believe he knew of this Rebound theory prior to taking on the job.Should this have been identified and fixed before the plaster went on? Seems to me other bids did not cover cost of bad gunnite, but did make reference that it would be fixed.

The spa floor was dirt?

How do they figure rebound is causing a leak? Gunite isn't waterproof anyway, plaster isn't even totally waterproof. You would have to have some pretty obvious cracks for that to be causing a leak. How do you know is not in the plumbing?
