Neighboring Fences

Just an update the PB is relatively certain we can use the neighbors fence since they have a pool, but they said inspectors can be unpredictable so nothing is guaranteed. I do have an email out to the town and going to get it confirmed, if they ever get back to me - it's been a week now.

Final update: had a pre-construction meeting with the inspector today. She said we will not be able to use the neighbors existing wood fence because someone can climb into our yard from their side. Her suggestion was to do one of the following: 1) ask the neighbor if we can put pickets on the other side thus making it pool compliant. 2) ask the neighbor if we can tear down their fence and build a new dual sided pool compliant fence in it's place 3) build a new fence at least 3' off the existing fence. Just thought I would update in case anyone else ran into this issue.
 
Thanks for the update, always good to store stuff for possible future use. Picketing his side of the fence 'really showing its age' will help in the short term and be a total waste in the near future. He might even claim that all the extra nails/screws killed his fence and want you to replace it. Would he be open to splitting the bill to redo it with a fence that had something more panel like and less picket-y ? If he is going to have to replace it soon anyway, and you build one now right next to it, it would help you both alot to just split a new unclimbable fence.
