Heater placement

I'm in the middle of a pool build and having a hard time as to where I can place the heater. I am in a zero lot line subdivision and only have access on 1 side of my house which happens to be the main pathway from front to back. Originally, my plan was to have the equipment place on that side, however, I've received feedback that the heater would be too close to a functioning windows that is never used. Builder wants to place the heater dead center in the middle of the path to be at least 5 ft away. My suggestion would be to replace the windows with a picture window vs a functioning window and place a carbon monoxide detector inside. I an out of the city limits so not subject to inspections. Looking for suggestions.
