Lowering water in partial perimeter overflow spa

New pool/spa build. Partial perimeter overflow spa. That is, the spa is raised and approx 3/4 spills into the pool. (the rest is outside of pool and raised above concrete patio). The overflow of the spa was a 'during construction' change.

Pentair equipment

When we turn the spa on (particularly with jets on), and get in, the water level is too high and spills not only into pool but also onto concrete patio. We can manually lower the spa water level by turning the check-value to push the water back to the pool for 1 min or so. And then we get in heated spa and turn on jets and all is fine.

But we think there has got to be a plumbing/equipment solution (and corresponding programming solution (we think we can use Aux on pentair phone controller)) that works better.

Thoughts? Check valve? New circuit?

Can you post a picture of your spa? My spa is at the same level as the deck and pool and there is a 1 foot wide spill over. When people get in the water rises and goes over the spillover but not onto the deck. All the water should go over the spillover area unless they built it too high.
 
spa.jpgThe spa is approx. 6 inch raised from patio. It is surrounded on 3 sides by the pool and one side by the patio. It overflows on all three sides by the pool (spa is slightly angled with tile (not noticeably to naked eye)).
