Pool fence / barrier question - in Georgia (pre-existing aluminium fence)

My wife and I have been discussing an in ground pool in Georgia and it appears that our 4 foot aluminum fence may not meet local code for a residential pool barrier.

Does this mean that we will have to replace the entire fence for the pool permits to be approved?

Or is the pool fence not contingent on the pool permit?

The fence was installed about 6 years ago and was supposed to be a maintenance free long-term fencing option... the idea of replacing a $8k fence is, well, depressing. haha.

Anyone have any experience with this. We are not speaking with any pool companies just yet so thought I would see what the board thinks.. thanks.
 
What makes you feel that the fence won't meet local codes

There are code requirements that top rail and bottom rail must be >= 45" apart .... so for a 4' fence to work, there is really only 1 specific style that meets code.

Also the top of fence must be at least 48" high... and while ours in close... in some areas the pickets only reach 46" - 47" inches.

JMO, but I think that for an inpector to fail that, they'd really have to be picky and splitting hairs. Also, I'd seriously doubt they will measure each individual picket.

I'd pull the permit and see what happens
 
I live in Michigan and I believe our code is the same. That type of fence you have would not pass code here. That horizontal bar would work as a step and not pass. You could install rolled wire fencing, like you would use on a split rail fence on the outside and that would allow it to pass. They make it in black so that would blend in pretty well. Cheaper than buying a new fence. I have the second fence that you are showing.

This is what I am afraid of.

The other option I've considered is just putting the pool fence around the pool area vs. replacing the entire yard fence... wife isnt sold on that idea. Would be MUCH cheaper.
