Hello pool forum members. My family hired a pool builder to build a 20x40’ pool 8.5’ deep and 3.5’ deep. Vinyl liner with vermiculite bottom. The builder did a hack job on our pool floor using poolkrete. We posted on this forum and we’re told by many, all of which stated to tear it out and do it over. That same company came and did it over and is marginally better but still far from acceptable. We have a change in grade every 1-2’, nothing is smooth, if you put a straight edge on any part of the pool you’ll see huge depressions. It’s too shallow in the center of the shallow end and pockets that are too deep near the main drain. The lines where the walls meet the floor aren’t not defined and I’m told by several local builders our liner will not fit correctly and we’ll see and feel all of the imperfections when the liner goes in. After some heated arguments with the pool builder he agreed to give me money back for the total cost of hiring another company to finish the pool. I’ve found someone but now he doesn’t have any money or credit to pay the new installer. Is there a pool inspector or expert witness in MN/WI we could hire to document the poor workmanship so we have some leverage(possibly in court)? We’re desperate at this point and have come up short searching and calling almost everyone online. Thanks in advance for any help!

I don't know of any experts. But get estimates on what it would take to fix the issue with quotes and see if the current builder will put the money in escrow for someone else to fix it. Also make sure you expectations are detailed out in the contract you have with whoever is going to fix it.

Hello TFP community, I'm trying to get the technical specs for a Steel panel pool kit by latham pools. 42" panels. I've tried calling Latham Pools but unless you're a dealer they won't take your call. Does anyone have access to the tech specs and install instructions for a 20' x 40' Steel Panel 42" Kit from latham? Nothing on the latham website.

I'm specifically looking for data as it relates to the amount of lateral pressure allowed for the wall panel. Specifics to the backfill material allowed with this kit. Unfortunately, I'm in a legal battle with my builder due to all of the wall panels bowing in. The soil tests indicate that they backfilled with a clay, sand, silt mix vs clean fill. Thanks in advance!!

If the panels are bowing, then how can they deny responsibility?

Either the panels are defective or the installation is defective.

You need your own expert to evaluate the materials and workmanship and advise you if one or both are defective.

File a warranty claim and ask for the “standardized branded pool blueprints coded with ICC-ES report numbers, stamped and signed by licensed engineers”.

Contact ICC-ES to request a copy of the report.

It’s unlikely that the panels are defective.

Most likely, the backfill was over compacted or maybe the braces were not installed correctly.

Do you have a way to test the lateral pressure of the backfill?

If yes, what readings are you getting?


 
Backfilling behind the pool panels then takes place using clean, porous soils, free of roots and debris, installed and carefully tamped in layers not to exceed 12 inches (305 mm) in thickness to eliminate voids.

The backfill placement and filling of the pool with water are to be accomplished concurrently in order to prevent uneven loading on the pool panels and avoid the potential collapse of the pool wall.

BACKFILLING

DO NOT USE EXPANSIVE SOIL TO BACKFILL SWIMMING POOLS.

Materials such as sand, bank run gravel and pea or #1-2 stone are ideal for backfilling.

Before beginning this phase of the job, be certain all work related to WATER MANAGEMENT has been completed.

Polymer wall systems should not be exposed to direct sun light for more than two weeks.

Ultraviolet rays can cause crazing of the panel skin.

The recommended method for backfilling a swimming pool is to elevate the level of the material being used at the same rate as the water level inside the pool.

Deviations from this recommendation should always include measures that guarantee the structural integrity of the pool wall system.

Use equipment such as a skid-steer to carefully place the material into the overdig.

Compact it in layers to avoid settling after a deck is installed.

Upon reaching the top of the wall system, leave the brace tops exposed to allow concrete (if that is what is chosen) from the deck to encompass the upper brace rail.
 
The Wisconsin Little Miller Act

The Wisconsin Little Miller Act is a Wisconsin state law which states that contractors are required to hold payment bonds if the job is over $10,000, and both payment and performance bonds are required for jobs over $30,000.


The Wisconsin Home Improvement Practices Act (HIPA) involves home improvement projects that are performed on residential, or non-commercial, buildings. Home improvements are considered the remodeling, repairing, painting, modernization, or additions of a property. It does not involve new constructions or major renovations.

Wisconsin law states that a person who files a claim under the Wisconsin Home Improvement Act may recover double damages, or twice the amount of the loss and attorney fees.


Did the contractor have the required bonds?

File a claim with the bond company.

Some states have a Contractor Recovery Fund.

The fund reimburses consumers who have suffered a financial loss as a result of a licensed residential building contractor or residential remodeler who has engaged in fraudulent, deceptive or dishonest practices, converted funds or failed to perform.

Contact the state and local contractor departments to ask for their help.

Check to see if the builder is Licensed and Certified.

Do you have the required building permits?

Have all inspections been completed and passed?

SPS 305.31 Dwelling contractor.

(1)  General. Pursuant to s. 101.654 (1) (a), Stats., no person may obtain a building permit for a one- or 2-family dwelling unless the person complies with all of the following, except as provided under s. 101.654 (1) (b) and (c) 2., Stats.:

(a) Holds one of the following credentials issued by the department:

1. A dwelling contractor certification.

2. A dwelling contractor — restricted certification.

(b) Holds or engages, as an employee, a person who holds a certification issued by the department as a dwelling contractor qualifier.

Note: Section 101.654 (1) (b), Stats., exempts an owner of a dwelling who resides or will reside in the dwelling and who applies for a building permit to perform work on the dwelling from obtaining a dwelling contractor financial responsibility certification.

Note: Section 101.654 (1) (c) 2., Stats., reads: “The continuing education requirements under par. (a) and the rules promulgated by the department under sub. (1m) do not apply to any person who holds a current license issued by the department at the time that the person obtains a building permit if the work the person does under the permit is work for which the person is licensed."

(2)  Application for dwelling contractor certification. A person applying for a dwelling contractor certification or a dwelling contractor — restricted certification shall submit all of the following:

(a) An application in accordance with s. SPS 305.01.

(b) An application fee and a certification fee in accordance with s. SPS 305.02, Table 305.02.

Note: A dwelling contractor — restricted certification will be issued to an individual who applies using a bond of less than $25,000. The card issued by the department for a dwelling contractor — restricted certification will read “Financial Responsibility-by a bond under $25,000 Certification".

(3)  Qualifications for certification.

(a) A person applying for a dwelling contractor certification or a dwelling contractor — restricted certification shall provide all of the following:

1. A statement certifying that the person complies with the worker's compensation requirements and unemployment compensation requirements as specified under s. 101.654 (2), Stats.

2. Evidence of compliance with the liability or bond insurance requirements as specified under s. 101.654 (2) and (2m), Stats.

(b) The person applying for a dwelling contractor certification or a dwelling contractor — restricted certification shall be the owner of the contracting business, a partner in the contracting business applying on behalf of a partnership, or the chairman of the board or chief executive officer applying on behalf of the contracting corporation.

(4)  Responsibilities.

(a) A person who holds a dwelling contractor certification or a dwelling contractor — restricted certification shall comply with the responsibilities under s. 101.654 (4), Stats.

(b) For any construction project that requires a uniform building permit under s. SPS 320.08, a person who holds a dwelling contractor certification or a dwelling contractor — restricted certification may not commence construction until a permit is issued for the construction.
