Flow Vis bypass question

I have a pool with a flow vis installed after the heater but before the tee where the diverter valve sends the water when it would be in heater bypass mode. Basically if I bypass the heater the flow vis would be dead. Can I consider it then to be a check valve while in the bypass mode.

The following is a cut and paste from e'pool supply:
