Why is diverter valve not in fully open/closed position

That valve is part of the system that lets some water go back to the spa for your spillover when in the Pool mode.

Not sure where else the two pipes that exit that valve go.

The valve needs to be open for the pipe out the bottom, as that is what allows the water to flow back through the blue ball valve, and then back to the spa for the spillover. I assume the pipe that goes down also feeds your pool returns.

Not sure where the pipe that exits to the left goes.. Maybe a waterfall??

Turn the handle so it is pointed straight up and see if the spa overflow stops and the Eyeball returns stop.

Turn the handle to point dead level to the right and see what quits working.

You can determine what it controls by putting the handle in the twelve o'clock position and then the three o'clock position, running the pump, and see what changes. It is possible that it is your spa overflow to allow filtered water to enter the spa during pool filtration. DO NOT place the handle at nine o'clock. That appears to dead-head the pump and could cause damage and/or injury.
