I replaced the Hayward top valve, and now when in filter mode the water is going to backwash along with the filter.

Can you tell us the model number of the old valve and the new one?
It's possible that you got a bad valve, but that's not likely. Let's do a little research and troubleshooting before we make that decision .

The model number is: SP0714T on both the old and new top valve.

Yes, I pulled it out of the box, and replaced it in the same position as the old one.
That pretty much says that it's bad. Just to be sure, there wasn't any shipping clips or tags that needed to be removed when installing were there? Maybe a clip under the handle that keeps pressure off the spider gasket until installed?
I didn’t notice any clips, should I take the top off and check the spider gasket? Or would just returning it be the best solution?

Have you tried pressing down on the center of the handle to see if it stops leaking out the waste port?

Small chance, but the handle may have been put on the diverter backwards.
In that case you would be backwashing while the valve is set in filter mode.
Maybe just the spider gasket was not set right.
