Skimmer Installation Concerns

Our skimmer is glued in & ready to be encased. My concern is that it isn't under the coping; and that the coping section above the skimmer has not been removed. I will insist that it is removed. Your comments are appreciated.
Images show the new skimmer and I have a schematic of the old v. new.

Have you talked with the builder? He obviously set it back on purpose.

061915:
1. Builder notified via plumber; plumber's supervisor; and supervisor's boss: all have [basically] the same response: it will not be a problem;
2. Builder is very cooperative and is willing to remove the said coping piece in order to [better] prepare the surfaces adjacent to the skimmer throat for the subsequent tiling;
3. My concern arises from the comparison of where the old skimmer was and where the mfg's instructions say to put it, when compared to where it is now. About a 6" further away from the pool.
