Pool with heater equipment - No-drain acid washing

We built our new pool last summer. It was in July that the plaster was complete. The day after plastering, the acid washing started late in the afternoon (due to the late arrival of the crew) and the job took until after the sunset when it got dark. After the pool was filled with water, I noticed uneven color in some areas of the pool bottom. Considering that the acid washing was done at the end of day and it was finished after the sunset, I was not sure whether the uneven color was really because of the bad acid washing job or not. I talked to the builder and after 1.5 months, he added about 10 gallons acid into the pool water and brushed the area to fix the issue. But it wasn't fixed. The winter started and the builder didn't ask me for the last payment (check) of the construction. Now, after more than 10 months, the builder contacted me. He said that, this time, he would have the plaster company to do "no-drain acid washing". I know that the builder is following up now to do something to receive the last payment (check), then. However, I am not sure if this solution will be the best treatment for my case, particularly since the builder himself added the acid once before but no success. I am afraid that it makes the case worse (makes the surface rougher and/or causes additional discolorations). Additionally, I am not sure if my heater or other equipment gets damaged due to the acid (I should mention that my heater has bypass and a check valve). I do appreciate it if you could help me with your thoughts. Should I choose to live with it or let the builder do "no-drain acid washing"? I was also commented by the other TFP members to push the builder to drain the pool water instead of acid washing and have the plaster finish lightly sanded and polished with 80/100 grit wet/dry sandpaper. I am not sure the builder accept it. He is very towards to "no-drain acid washing" and says there will be no issue to the equipment since the pump will be off. Appreciate any comments.

Each time you acid wash a pool plaster it shortens its lifespan. Basically they're removing a slight layer of plaster each time.
You will have to consider if you will accept that, once again, or does it need a chip out and new plaster applied under warranty? The surface sanding is something I know very little about in this situation.
Personally the pics show a horrible finish to me, but that's just my opinion.
How much more do you owe the builder?
